BATCH Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BATCH mobile application, website, and related services (collectively, the “Service”) operated by BATCH (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

  1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use BATCH. The Service is currently intended for users in Utah and surrounding areas. By using the Service you represent that you meet these requirements and that all information you provide is accurate.

  1. Account Registration & Security

You must create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

  1. Description of the Service

BATCH is a human-powered matchmaking platform. Volunteer “Batchers” review profiles and facilitate introductions. Matching is chat-first: once introduced, users may message and then choose to accept or decline further interaction. There is no “pending” match status that requires mutual acceptance before conversation can begin.

Free tier: Limited number of active matches.

Premium subscription: Higher match limits and additional features (including access to select Batchers where available).

We do not guarantee any number of matches, the quality of matches, or that any match will result in a relationship, date, or further contact.

  1. Batchers

Batchers are independent volunteers. They are not employees, agents, or representatives of BATCH for purposes of employment, agency, or partnership law. Batchers earn recognition, badges, and points based on activity and reported match outcomes; they receive no monetary compensation from BATCH. BATCH does not control or guarantee the decisions, recommendations, or quality of any Batcher’s work. You interact with Batchers and other users at your own risk.

  1. User Conduct

You agree to use the Service only for lawful, respectful purposes. Prohibited conduct includes, but is not limited to:

Harassment, threats, hate speech, or discrimination

Sharing explicit, pornographic, or non-consensual intimate content

Impersonation, catfishing, or providing false information

Soliciting money, scams, commercial spam, or multi-level marketing

Attempting to reverse-engineer, scrape, or interfere with the Service

Using the Service while banned or creating multiple accounts to evade restrictions

Any activity that could harm other users, Batchers, or BATCH

We may remove content, restrict features, or terminate accounts that violate these rules, with or without notice.

  1. Safety & Interactions

BATCH is a platform that connects people; we do not conduct background checks, verify identities beyond basic account information, or guarantee the safety or intentions of any user or Batcher. You are solely responsible for your interactions, both on and off the Service. Exercise caution when meeting in person, sharing personal information, or exchanging contact details. Report suspicious or harmful behavior through the in-app reporting tools or by contacting us.

  1. Subscriptions, Payments & Refunds

Premium subscriptions are billed in advance on a recurring monthly basis through the app store or payment processor you select. By subscribing you authorize recurring charges until you cancel. Cancellation takes effect at the end of the current billing period. Refunds are handled according to the policies of the applicable app store (Apple App Store or Google Play) or payment processor. We do not provide pro-rated refunds for partial months except where required by law.

  1. Intellectual Property

The Service, including its design, text, graphics, logos, and software, is owned by BATCH or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our prior written permission. You retain ownership of content you post, but grant BATCH a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for operating and improving the Service.

  1. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share information. By using BATCH you consent to those practices.

  1. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT MATCHES WILL BE SUCCESSFUL, THAT BATCHERS WILL PERFORM TO ANY STANDARD, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BATCH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND VOLUNTEERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR $100 IF YOU HAVE NOT PAID US ANYTHING).

  1. Indemnification

You agree to indemnify and hold harmless BATCH and its officers, directors, employees, and volunteers from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, your interactions with other users or Batchers, or your violation of these Terms.

  1. Termination

You may delete your account at any time. We may suspend or terminate your access immediately if you violate these Terms or if we decide to discontinue the Service. Upon termination, your right to use the Service ends and we may delete your account and content in accordance with our data retention practices.

  1. Governing Law & Disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah. You consent to personal jurisdiction there.

  1. Changes to These Terms

We may update these Terms from time to time. We will post the revised version and update the “Last Updated” date. Continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you do not agree, stop using the Service and delete your account.
